SAMPSON V M

STATE OF TASMANIA v VICKI MAREE SAMPSON                                25 JUNE 2021

COMMENTS ON PASSING SENTENCE                                                            PEARCE J

Vicki Sampson, you plead guilty to dealing with the proceeds of crime. On 7 September 2020 the police found $430 in cash in your handbag which you admitted was the proceeds of recent sales of cannabis. You are aged 52. Over the last few years you have committed a number of drug related offences. In 2017 you were given a suspended sentence for selling cannabis. When this money was found you were also charged with possessing, using and selling cannabis and unlawfully possessing other property. Two weeks ago, on 11 June 2021, a magistrate activated the four month suspended sentence from that day and ordered a separate term of four months, two months of which was to be served concurrently and two months of which was suspended. Those sentences arise from the same facts for which I am to now sentence you. The money was the proceeds of the selling for which you have already been punished. Given the modest amount of money involved, I think the sentence the magistrate imposed is already a just and appropriate reflection of your total criminality.

You are convicted on count 4 on complaint 34454/20. I am satisfied that the sum of $430 is tainted property as the proceeds of drug sales and that no hardship will result from its forfeiture. I order, pursuant to the Crime (Confiscation of Profits) Act 1993, s 16(1) that the money is forfeited to the State. You are otherwise discharged.
