PICKEN, G M

STATE OF TASMANIA v GREGORY MAXWELL PICKEN      13 NOVEMBER 2023

COMMENTS ON PASSING SENTENCE                                                 ESTCOURT J

Mr Picken, I simply repeat what I said in my Comments on Passing Sentence on 16 June this year, when I deferred your sentence.  Your present circumstances do not leave me with anywhere to go.  I was hopeful that if you got through the deferred sentence, we would be able to have another look at home detention, or even a Drug Treatment Order might be possible if you had got back onto drugs, but now I do not see any eligibility for home detention and no eligibility for a Drug Treatment Order, so all I am left with is the ability to impose a prison sentence.

You are sentenced to two years’ imprisonment, backdated to 8 August 2023, but I will allow parole and the maximum parole period allowed.  You will be eligible for parole after you have completed 12 months of the sentence I have just imposed.
