PRACTICE DIRECTION

The following Practice Direction is published by direction of the Chief Justice, the Honourable Justice Underwood AO.

This Practice Direction replaces 39/1983, 19 June 1995 and 9/2005.

PAPERS FOR THE USE OF A JUDGE OR THE ASSOCIATE JUDGE

Unless otherwise directed by the Registrar a practitioner who takes out an application before a Judge or the Associate Judge shall at least two clear days before the hearing deliver one set of papers containing a copy of the application and of each other document to which it is intended to refer at the hearing.

The set of papers shall be certified by that practitioner as correct and complete.

In the case of papers for use on a miscellaneous civil business day the papers should be lodged no later than 2.00 p.m. on the Thursday prior to the day of hearing.

Failure to lodge the papers may result in the application being delisted.

It is not necessary to provide "judge's papers" for the Associate Judge unless affidavits are to be read.
