CIRCULAR TO PRACTITIONERS

SUPREME COURT AMENDMENT (MISCELLANEOUS)
RULES 2009 S/R 74 of 2009

The above amendments will take effect from 15 July 2009.

The amendment rules:

(a) Provide for discovery of documents from third parties in a new rule 403FA;

(b) Increase certain of the fees payable in respect of proceedings and decrease the fee payable for commencement of proceedings for admission to the legal profession. The fees were last increased in July 2004;

(c) Make miscellaneous amendments including:

  • amendments to rules 116; 242; 827; 837; Schedule 1 Part 2 3 and 4; and Schedule 2 section 7 to change $20,000 to $50,000;
  • amending rule 202 so that a defendant can file and serve a third party notice without leave within 30 days after delivering the defence;
  • minor amendments to rules 717 and 721 to change the roman numeral reference in rule 717 and replace reference to “judge” with “the Court or a judge” to reflect the wording of rules 719, 720(2) and 723(e);
  • Part X of the Rules of the Supreme Court 1965 is added to the list of rescinded parts in Schedule 5, Clause 1(1).

The new fees payable under Schedule 2 of the Supreme Court Rules are attached.
