Circular to Practitioners

No 12 26 September 2008
Justices (Review) Amendment Rules 2008 (SR 114.2008

These rules came into effect on 24 September 2008 and allow for consent orders, including an order dismissing a notice to review to be made without the need to bring the parties before the Court.

Orders such as dismissal, amending names and orders other than agreeing to allow or uphold motion to review can be made by consent memorandum to the Registrar signed by the parties or their solicitor. A judge in Chambers may make such orders in the absence of the parties.

An applicant will now be able to file a notice of discontinuance of a notice to review.
