CIRCULAR TO PRACTITIONERS

CIVIL FEES AND ENDORSED COSTS

The fees payable, and endorsed costs claimable, in Supreme Court proceedings from 1 July 2013 are set out below.

As a result of the annual increase in the value of a fee unit under the Fee Units Act 1997 ($1.46 from 1 July 2013), the Appeal Costs Fund component of the fee payable on a writ (commencing an action) in the Supreme Court will, on 1 July 2013, increase from $43.20 to $43.80.

FEES

1. Originating Application $600.00

2. Writ (includes Appeal Cost Fund fee)

(a) If claim exceeds $50,000 $643.80

(b) If claim does not exceed $50,000 $343.80

3. On commencement of proceedings for Admission to the Legal

Profession $150.00

4. On filing any notice instituting an appeal from any order or

Judgment of the Court or any Judge of the Court; or from the

Associate Judge to the Full Court $700.00

5. On filing any notice instituting an appeal from an inferior court,

statutory tribunal or referee $600.00

6. Transcripts

(a) for a copy which has already been transcribed $ 2.00 per page

(b) for a copy which is required to be transcribed $ 7.50 per page

7. On taxation of a bill of costs – 4% of the amount allowed or

such lesser amount as the taxing officer, in the officer’s

discretion, thinks proper

8. For every search or inspection of any index, register, file or other

document, except where any such search or inspection is made by

a person who is a party to that cause or matter or the solicitor for

that party $ 25.00

9. For any photocopy or scanning of a document $ 2.00 per page

10. On the appointment of a mediation if the mediator is an employee

of, or otherwise engaged by, the Supreme Court $500.00

11. Writ of Execution (e.g. FiFa and/or Possession)

(a) On debts not exceeding $20,000 $100.00

(b) On debts exceeding $20,000 $200.00

The calculation of fees payable and costs claimable on writs for liquidated demands exceeding $50,000 filed on or after 1 July 2013 is as follows:
